DWI Dismissed for Failure to Prosecute

August 19, 2010-A client was charged with DWI more than 10 years ago and was recently called upon to defend the charge.  Mr. Scura made a motion to dismiss based upon failure to prosecute, arguing that the lapse of time prejudiced the defendant.  The prosecutor could not justify the delay and the Judge dismissed the charge.

DWI DISMISSED

March 23, 2010 -  The defendant, represented by Mr. Scura was charged with Driving While Intoxicated.   After the prosecutor’s office failed to respond to Mr. Scura’s discovery request, he filed a motion to dismiss for failure to prosecute and failure to provide discovery.  After a vigorous oral argument, Mr. Scura’s motion was granted and the charge was dismissed.

Not Guilty Verdict in Contempt Case

March 19, 2010- The defendant in this case was accused of criminal contempt for violation of a final restraining order.  At trial the defendant was represented by Mr. Scura, who successfully argued that there was insufficient proof that a violation of the restraining order occurred.  Following trial the defendant was found Not Guilty of all charges.

Clients Awarded $6,000 Plus Legal Fees

January 25, 2010- Following a trial for a breach of contract in Morris County, the plaintiffs represented by Mr. Scura were awarded $6,000 in damages plus attorney’s fees.

Theft Charges Dismissed

January 2010- Client charged with THEFT for alleged use of a stolen debit card.  All charges DISMISSED.

Client Not Guilty of Driving While Intoxicated

December 2009 – Client charged with Driving While Intoxicated, found NOT GUILTY following trial because the State was unable to prove intoxication beyond a reasonable doubt.
